Protection of personal data under the GDPR

Legal Notice Méndez Comunicación – PRSC. S.L., in application of the regulations in force regarding personal data protection, hereby informs that the personal data collected through the forms of the Website: www.mendezcomunicacion.com, are included in the specific automated files of users of the services of PRSC. S.L. The purpose of the collection and automated processing of personal data is the maintenance of the commercial relationship and the performance of information, training, consultancy and other activities of PRSC. S.L. These data shall only be transferred to those entities that are necessary for the sole purpose of complying with the aforementioned purpose. PRSC. S.L. adopts the necessary measures to guarantee the security, integrity and confidentiality of the data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

The user may at any time exercise the rights of access, objection, rectification, erasure, restriction of processing, and data portability recognized in the aforementioned Regulation (EU). The user declares that all data provided is true and correct and undertakes to keep it updated, informing PRSC. S.L. of any changes.

For what purpose will we process your personal data?

At PRSC. S.L., we will process your personal data collected through the Website: www.mendezcomunicacion.com, for the following purposes:

  • In the event of contracting the goods and services offered through www.mendezcomunicacion.com, to maintain the contractual relationship, as well as for the management, administration, information, provision, and improvement of the service.
  • Sending information requested through the forms available on www.mendezcomunicacion.com.
  • We remind you that you can opt out of receiving commercial communications by any means and at any time by sending an email to the address indicated above.
  • The fields in these records are mandatory, and it will be impossible to fulfill the stated purposes without providing this data.

How long is the personal data collected retained?

The personal data provided will be retained as long as the business relationship is maintained or you do not request its deletion, and for the period during which legal liability may arise for the services provided.

If you do not provide your information, or if you provide it inaccurately or incompletely, we will be unable to process your request, making it impossible to provide you with the requested information or complete the contracting process for services.

>> Recipients:

The data will not be shared with any third party outside of PRSC. S.L., except under legal obligation. As data processors, we have contracted several service providers, who have committed to complying with the applicable data protection regulations at the time of their contracting.

>> Data collected by users of the services:

In cases where the user includes files containing personal data on the shared hosting servers, PRSC. S.L. is not responsible for the user’s non-compliance with the GDPR.

>> Data retention in accordance with the LSSI:

PRSC.S.L. informs you that, as a data hosting service provider and pursuant to the provisions of Law 34/2002 of July 11, on Information Society Services and Electronic Commerce (LSSI), it retains for a maximum period of 12 months the essential information to identify the origin of the hosted data and the time at which the service began. The retention of this data does not affect the confidentiality of communications and may only be used within the framework of a criminal investigation or to safeguard public security, and may be made available to judges and/or courts or the Ministry that so requests. Data will be communicated to the State Forces and Corps in accordance with the provisions of personal data protection regulations.

>> Intellectual property rights:

The user must respect the third-party programs made available to them by PRSC. S.L., even if they are free and/or publicly available. PRSC. S.L. holds the necessary exploitation and intellectual property rights to the software. The user does not acquire any rights or licenses for the contracted service, over the software necessary for the provision of the service, nor over the technical information for monitoring the service, with the exception of the rights and licenses necessary for the fulfillment of the contracted services and only for their duration. For any action that exceeds the fulfillment of the contract, the user will need written authorization from PRSC. S.L. The user is prohibited from accessing, modifying, or viewing the configuration, structure, and files of the servers owned by PRSC. S.L., and assumes civil and criminal liability arising from any incident that may occur on the servers and security systems as a direct consequence of negligent or malicious action on their part.

>> Intellectual property of the software:

The use of the services provided by PRSC. S.L., and in particular the following, in violation of intellectual property laws, is prohibited:

  • Any use that is contrary to Spanish law or infringes the rights of third parties.
  • The publication or transmission of any content that, in the opinion of PRSC. S.L., is violent, obscene, abusive, illegal, racial, xenophobic or defamatory.
  • Cracks, program serial numbers, or any other content that violates the intellectual property rights of third parties.
  • The collection and/or use of other users’ personal data without their express consent or in violation of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
  • Using the domain’s mail server and email addresses to send unsolicited bulk email.

The user is fully responsible for the content of its website, the information transmitted and stored, hypertext links, third-party claims, and legal actions regarding intellectual property, third-party rights, and the protection of minors.

The user is responsible for all applicable laws and regulations and rules relating to the operation of the online service, e-commerce, copyright, maintenance of public order, and universal principles of internet use.
The user shall indemnify PRSC. S.L. for any expenses incurred by the attribution of PRSC. S.L. in any case for which the user is responsible, including legal fees and expenses, even in the event of a non-final court decision.

>> Intellectual property of the hosted content:

PRSC. S.L., in compliance with current regulations on personal data protection, informs you that the personal data collected through the forms on the website www.mendezcomunicacion.com are included in the automated files specific to users of PRSC. S.L.’s services.

>> Protection of hosted information:

PRSC. S.L. makes backup copies of the content hosted on its servers; however, it is not responsible for the loss or accidental deletion of data by users. Likewise, it does not guarantee the complete restoration of data deleted by users, as such data may have been deleted and/or modified since the last backup. The services offered, except for specific backup services, do not include the restoration of content stored in backup copies made by PRSC. S.L. when this loss is attributable to the user. In this case, a fee will be determined according to the complexity and volume of the recovery, always subject to the user’s acceptance. The restoration of deleted data is only included in the price of the service when the loss of content is due to causes attributable to PRSC. S.L.

>> Commercial communications:

Pursuant to the LSSI (Spanish Law on the Use of Personal Data), PRSC. S.L. will not send advertising or promotional communications by email or other equivalent means of electronic communication unless previously requested or expressly authorized by the recipients. In the case of users with whom there is a prior contractual relationship, PRSC. S.L. is authorized to send commercial communications regarding PRSC. S.L. products or services that are similar to those initially contracted with the client. In any case, the user, after proving their identity, may request not to receive further commercial information through Customer Service channels.
